Hearing Bodies for Code of Student Conduct Violations
Back to Judicial Processes and Procedures
The following describes the hearing bodies for Code of Student Conduct violations.
Director for Student Judicial Affairs
The Director for Student Judicial Affairs is responsible for the administration of the university judicial process and also serves as the primary hearing officer. The Director serves as a hearing officer in informal proceedings and formal administrative hearings. The Director also advises the Health Center Student Conduct Standards Committee, the College of Law Honor Committee, and the Student Honor Court.
Assistant Director for Student Judicial Affairs
The Assistant Director in the Student Judicial Affairs Office serves as a hearing officer in informal and formal proceedings. The Assistant Director also conducts informational meetings with students prior to formal hearings with the appropriate hearing body and advises the Student Conduct Committee.
Coordinator of Residential Judicial Programs
The Coordinator of Residential Programs is responsible for coordinating the judicial process within the Division of Housing. This staff member serves as an administrative hearing officer in informal proceedings and also reviews and makes final decision on recommendations from the Residence Hall Conduct Boards.
Residence Life Coordinators
Residence Life Coordinators can give out written reprimands for minor violations when the student accepts responsibility. Residence Directors also serve as hearing officers in an informal proceeding involving residence hall cases of a less serious nature and the student does not want a formal hearing.
Student Conduct Committee
Composed of students and faculty members appointed by the President of the University, this committee is the alternative to administrative hearings available to all students in the judicial process. This committee determines the facts of the case and makes recommendations concerning responsibility and the imposition of a sanction to the Dean of Students. The student has the opportunity to meet with the Dean of Students prior to a final decision being made on the case.
Greek Judicial Board
Composed of students who are affiliated with all 4 Greek councils. This group hears information presented and makes a recommendation to the Dean of Students, who then accepts or rejects the recommendation.
Hearing Bodies for Cases of Academic Honesty
The alleged violation, depending upon the college, may be resolved through the Faculty Adjudication Process, the Student Honor Court, the Committee on Student Conduct, the Health Center Student Conduct Standards Committee, or the College of Law Honor Committee.
Faculty Adjudication Process
When a student is alleged to have violated the Academic Honesty Guidelines the faculty members involved should meet with the student and attempt to determine what disciplinary proceeding is warranted. The faculty member may impose a reduced or failing grade and an appropriate educational sanction if the student and faculty member reach agreement as to a sanction. The student's agreement to a sanction shall constitute an admission of responsibility and a waiver of all other available adjudication procedures.
Should the accused student feel the Faculty Adjudication is not appropriate or does not accept responsibility, the case will be referred to Student Judicial Affairs to discuss the evidence, judicial process, and hearing options.
Academic Honesty
Student Conduct Committee
The Student Conduct Committee is the alternative to an informal administrative hearing available to all students in the judicial process. The committe is composed of five to eight students, faculty and staff representatives appointed by the Vice President of Student Affaris atthe University. This committee determines the facts of the case and makes recommendations concerning responsibility and the imposition of a sanction to the Dean of Students. The student has the opportunity to meet with the Dean of Students prior to a final decision being made on the case.
Hearing Process
Health Center Student Conduct Standards Committee
This committee hears cases of academic dishonesty that occur in the Health Center Colleges. The faculty may use the Faculty Adjudication process outlined above, or may refer the case to the Health Center Student Conduct Standards Committee for adjudication. This committee is appointed by the President and is comprised of faculty, staff, and students from the Health Center Colleges.
The hearing process for the Health Center Student Conduct Standards Committee follows that of the Committee on Student Conduct, previously discussed in the hearing format section. This committee makes findings of facts and recommendations concerning responsibility and the imposition of a sanction to the Dean of Students. The student has the opportunity to meet with the Dean of Students prior to final determination.
College of Law Honor Committee
Comprised of nine students, two faculty, and an administrator from the College of Law, the Honor Committee deals with cases of academic honesty involving students in the College of Law. Three members of the Honor Committee need to be present for a hearing to occur. Final decision is made upon review by the Appellate Board.
The College of Law Honor Committee hearings follow the same basic process as the Committee on Student Conduct and the Health Center Student Conduct Standards Committee, however, prior to the hearing itself, a three person Probable Cause Subcommittee investigates the complaint and determines whether or not sufficient evidence exists to warrant conduct charges.
