Guidelines for Violations of the Code of Student Conduct That Occur Off Campus

The Dean of Students Office Student Judicial Affairs program uses the following as guidelines to determine if an off-campus incident involving University of Florida students warrant investigation and/or charges of violating the Student Code of Conduct. Examples of guidelines utilized in the decision process may include but are not necessary limited to the following:
- Degree of violence that occurred
- Extent of danger posed to the community
- Incident may result in a felony charge
- Drugs or weapons were involved
- Involvement of a student organization
- Students injured
- The student was acting as a representative of the University
- Students traveling to or from campus
- Location of incident with proximity to campus
- Judicial history of student(s) involved
- Date of incident
(The guidelines listed above are not in order of importance)
Decision to charge will be in accordance with University of Florida Rule 6C1-4.018:
"When a student violates city, state or federal law by an offense committed off the campus and which is not associated with a University-connected activity, the disciplinary authority of the University will not be used merely to duplicate the penalty awarded for such an act under applicable ordinances and laws. The University will take disciplinary action against a student for offense is such that, in the judgment of the Director of Student Judicial Affairs, the continued presence of the student on campus is likely to interfere with the educational process or the orderly operation of the University; the continued presence of the student on campus is likely to endanger the health, safety, or welfare of the University Community, or is intimidating or threatening to another individual within the University Community; or the offense committed by the student is of such a serious nature as to adversely affect the student's suitability as a member of the University Community. If the Director of Student Judicial Affairs determines that disciplinary action is warranted, the Director of Student Judicial Affairs shall so notify the student in accordance with Rule 6C1-4.016. The action of the University with respect to any such off-campus conduct shall be taken independently of any off-campus authority."
